Terms of Use

These Terms of Use ("Terms") govern access to and use of WeSingForFun.com and related services (collectively, the "Service"), operated by We Sing For Fun, LLC, a California limited liability company ("WeSingForFun," "we," "us," or "our"). By creating an account, uploading content, entering a contest, or otherwise using the Service, you agree to these Terms and our Privacy Policy, Copyright & DMCA Policy, and any Official Contest Rules that apply.

You must be at least 18 years old to create an account, upload content, comment, or enter any contest. The Service is not intended for children under 13, and children under 13 may not create an account or upload content.

You must provide accurate account information, keep your credentials secure, and promptly notify us of suspected unauthorized use. You are responsible for activity occurring through your account to the extent permitted by law.

"User Content" means videos, audio, images, captions, profile information, comments, and other material you submit to the Service. As between you and WeSingForFun, you retain ownership of your User Content, subject to the licenses and permissions granted in these Terms.

By submitting User Content, you grant WeSingForFun a non-exclusive, worldwide, royalty-free, sublicensable license, for as long as the User Content remains on the Service and for a reasonable technical backup period afterward, to host, store, reproduce, encode, transcode, compress, resize, crop for formatting, create thumbnails or previews from, transmit, display, perform, distribute, and otherwise use the User Content as reasonably necessary to operate, secure, improve, and provide the Service.

You also grant WeSingForFun a non-exclusive, worldwide, royalty-free license to use your publicly submitted User Content, account name, display name, and approved profile information to identify, feature, and promote the Service, including on WeSingForFun-owned websites, social channels, email, and promotional materials. We will not sell ownership of your User Content to another party. Where commercially reasonable, we will honor deletion of the underlying User Content from future promotional use, but materials already produced, distributed, or lawfully archived may not be retractable.

You represent and warrant that: (a) you own your User Content or have all rights, licenses, permissions, and consents needed to submit it and grant the licenses above; (b) each identifiable person appearing or heard in the User Content has consented to the recording and permitted uses, or you have authority to provide that consent; (c) your User Content does not violate copyright, trademark, publicity, privacy, contract, or other rights; and (d) your submission complies with these Terms and applicable law.

Do not upload commercial sound recordings, karaoke tracks, backing tracks, lyrics, musical compositions, video clips, or other third-party material unless you have permission or another lawful basis to use that material. Singing a song, playing music in the background, or labeling a submission "for fun" does not by itself establish permission to use copyrighted material. You are responsible for determining whether you have the rights necessary for your submission.

WeSingForFun does not grant you any license to music or other third-party content merely because the Service permits an upload. We may mute, block, remove, restrict, or decline to promote content that may implicate third-party rights.

• Content that infringes intellectual-property, privacy, publicity, or other legal rights.
• Content that is unlawful, threatening, harassing, defamatory, fraudulent, obscene, exploitative, or that depicts illegal conduct.
• Sexual or exploitative content involving minors, or content that endangers a minor.
• Malware, automated scraping, interference with the Service, account abuse, impersonation, or attempts to circumvent security or moderation.
• Manipulating contest entries, votes, judging, eligibility, or account systems.
• Using the Service to advertise or solicit without our permission.

We may review, reject, remove, restrict, mute, disable, or preserve User Content or accounts at any time when we reasonably believe doing so is necessary to enforce these Terms, protect users or third parties, comply with law, respond to rights complaints, protect the integrity of a contest, or operate the Service. We are not obligated to monitor all User Content.

Our Copyright & DMCA Policy is incorporated into these Terms. We may terminate, in appropriate circumstances, users whom we determine are repeat infringers. We may also remove content when we have actual knowledge of infringement or become aware of facts or circumstances from which infringing activity is apparent.

Promotions are governed by the Official Rules presented for that promotion. If these Terms conflict with Official Rules regarding a promotion, the Official Rules control for that promotion. No purchase is necessary unless a particular lawful promotion expressly states otherwise.

The Service, including its original software, site design, text, graphics, logos, compilation, branding, and other materials created by or for WeSingForFun, is owned by WeSingForFun or its licensors and is protected by applicable intellectual-property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.

If you voluntarily provide ideas, suggestions, or feedback about the Service, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use that feedback without restriction or compensation, provided this does not transfer ownership of your User Content.

The Service may rely on or link to third-party hosting, authentication, analytics, email, storage, social-media, payment, prize fulfillment, or other services. We are not responsible for third-party services, and their terms and privacy practices may apply separately.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WESINGFORFUN DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR THAT USER CONTENT WILL BE PRESERVED. SOME JURISDICTIONS DO NOT ALLOW CERTAIN DISCLAIMERS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WESINGFORFUN AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM THE SERVICE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID WESINGFORFUN DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW.

To the extent permitted by law, you agree to defend, indemnify, and hold harmless WeSingForFun and its owners, officers, directors, employees, contractors, and agents from third-party claims, liabilities, damages, judgments, losses, and reasonable legal costs arising from your User Content, your violation of these Terms, or your violation of another person’s rights. This provision will not require indemnification for WeSingForFun’s own conduct where prohibited by law.

Dispute-resolution terms should be finalized with counsel before adding an arbitration clause or special venue clause. Until finalized, these Terms do not publish an incomplete arbitration clause.

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules, except to the extent federal law or mandatory consumer law applies.

You may stop using the Service at any time. We may suspend or terminate access for violations, risk, legal compliance, or discontinuation of the Service. Provisions that by their nature should survive termination will survive. We may update these Terms; material changes will be communicated as required by law. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
